Terms of Service

These Terms of Service (“Terms”) govern your use of Telephone (the “Service”), operated by Matt Cheok and Damjan Stankovic (“Telephone,” “we,” or “us”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
Eligibility
You must be at least 13 years old to use Telephone. If you are under the age of majority in your jurisdiction, your parent or guardian must agree to these Terms on your behalf.
Your account
You create your account using Sign in with Apple. You’re responsible for keeping your Apple ID secure and for any activity that happens under your account. Let us know right away if you believe your account has been compromised.
What the Service does
Telephone lets you share spontaneous availability with friends you choose to connect with, and lets you place voice calls to them. The Service is free to use. We may introduce paid features in the future; if we do, we’ll let you know before charging you anything.
Acceptable use
You agree not to use the Service to:
- Harass, threaten, abuse, or impersonate any person.
- Send unsolicited friend invitations to people you don’t know.
- Violate any applicable law or regulation.
- Attempt to reverse-engineer, scrape, attack, or disrupt the Service or its infrastructure.
- Use the Service to send or distribute unlawful, harmful, or sexually explicit content.
- Use the Service in any way that infringes another person’s rights.
We may suspend or terminate accounts that violate these rules at our discretion.
Your content
You retain ownership of the content you provide to Telephone (such as your display name and profile picture). By providing this content, you grant Telephone a worldwide, non-exclusive, royalty-free license to display it to the friends you connect with, solely to operate the Service.
Voice calls and recording
Telephone does not record your voice calls on our servers. However, the other party may be using third-party tools to record audio on their end — this is outside our control. You are responsible for knowing and following any laws in your jurisdiction about recording calls.
Service availability
We do our best to keep the Service running, but we provide no guarantee of uptime or uninterrupted access. We may modify, suspend, or discontinue parts of the Service at any time for maintenance, legal reasons, or other operational needs.
Termination
You may stop using the Service at any time. You can request that we delete your account and the data associated with it through our Support page. We may suspend or terminate your account if you violate these Terms or if we’re required to by law.
Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Telephone will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claim arising out of these Terms or your use of the Service will not exceed one hundred US dollars ($100).
Indemnification
You agree to indemnify and hold Telephone harmless from any claims, losses, or damages, including reasonable attorneys’ fees, arising from your use of the Service or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction there.
Changes to these Terms
We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page. If the changes are material, we’ll let you know through the app. Continued use of the Service after changes take effect means you accept the new Terms.
